# 8% rental VAT: small flats still need an investor price

Our audit finds 373 small-flat records marked as 3% VAT included, with some ambiguous source phrases. Ask for the written investor quote.

Among 3,439 small-flat records in chathome.lu's audited subset, 373 are stored as 3% VAT included. That flag does not establish a valid investor price: some supporting phrases are ambiguous. The asking medians below help shortlist homes, but the announced 8% scheme requires a different regional and size-based price test and further conditions. Obtain the quote and legal evidence before comparing returns.

## Key takeaways

- The asking-price basis belongs beside the price before a landlord compares returns.
- An area filter and a commune median cannot establish eligibility for the announced social-rental VAT scheme.

## The price basis changes what a small-flat shortlist means

chathome.lu data shows **373 apartment records stored as 3% VAT included**, within an audited small-flat cohort of **3,439 records**. These records have a stored rate, inclusion flag and nonempty source phrase; that is a field audit, not confirmation of the price available to a landlord. The calculation was made on **19 October 2026** and covers recorded living areas from **10 to 120 m²**, with valid positive asking prices and plausible prices per square metre.

This is a subset of the first **12,000 active sale records** read in document-ID order. The read limit was reached, so it is neither a national inventory count nor a random market sample. Some stored source phrases are ambiguous: an example is “3% + 17%TVA”. Those fragments do not establish how the whole asking price was costed. We have not revalidated the original source pages or certified individual advertised VAT treatments.

The [indirect-tax authority's current housing VAT guidance](https://pfi.public.lu/fr/professionnel/tva/logement.html) distinguishes creation for the owner's own main residence from renovation, for which use as a third party's main residence can also qualify. It does not make every advertised price including **3%** VAT a price available for a newly created rental dwelling. Because the VAT basis can differ with the intended use, ask for a quote for your rental project. Applying a percentage to the full advertised price cannot establish its land and construction treatment.

## Why a small-flat asking median is not a legal cap

| Commune | Audited small-flat records | Median asking price/m² | Records stored as 3% VAT included |
|---|---:|---:|---:|
| Luxembourg City | 978 | €11,981 | 95 |
| Differdange | 200 | €6,774 | 9 |
| Esch-sur-Alzette | 259 | €7,500 | 10 |
| Sanem | 133 | €8,381 | 0 |

Calculated on **19 October 2026**; apartment records with recorded living area **10–120 m²**, medians rounded to the nearest euro. Existing and newly built homes are pooled. The figures are advertised prices on their stored basis, not prices normalised to one investor VAT treatment. They compare different mixes of homes and do not estimate a same-home location effect. The [price methodology](/en/prices/methodology) explains the distinction between asking prices and transaction evidence.

A zero in the last column means no record had the **3%-included stored flags and a nonempty evidence phrase** in that commune's audited cohort. It does not establish that every other price excludes VAT, has another rate, or is suitable for a landlord. Across the full small-flat cohort, **1,052 records** have a stored source phrase for a VAT basis. A nonempty phrase is not necessarily unambiguous; missing or insufficient evidence stays unknown.

## What the announced 8% scheme asks for

As of **19 October 2026**, the [government's July announcement](https://gouvernement.lu/fr/actualites/toutes_actualites/communiques/2026/07-juillet/16-meisch-roth-booster-wunnengsbau2.html) describes **8% VAT** for the creation of socially oriented rental housing, subject to cumulative criteria: area no more than **120 m²**; a sale price per square metre no higher than the Observatoire median for the region and dwelling size; a rental return limited to **4% of net invested capital**; letting for at least **10 years**; and a tenant certified eligible by the ministry.

The wording does not turn that **4%** condition into an observed net yield after running costs. Nor can a commune asking-price median stand in for the designated regional and size-based benchmark. We have not established the applicable operative median-cap table or the scheme's commencement date from the primary sources reviewed. Consequently, this audit gives **no count of eligible listings**.

The July text says the measure applies on entry into force of the law, without retroactivity. The separate [October affordable-housing announcement](https://gouvernement.lu/fr/actualites/toutes_actualites/communiques/2026/10-octobre/02-meisch-logement-abordable.html) says that law's amendments took effect on **2 October 2026**, addressing social-provider finance, regional land-funding limits and management. It does not establish commencement of the separate VAT scheme. The land-funding limits are not substituted for the proposed dwelling-price test here.

## Worked example: check a Differdange asking-price benchmark

For example, **€6,774/m²** is the median of **200** audited small-flat records in Differdange. It is therefore not a quotation for a particular purchase.

For a candidate apartment, request a written quote that states the price for the intended rental use, the treatment of land and construction, the VAT basis and any eligibility assumptions. Then obtain the legal benchmark and its region and size band, the applicable commencement rules, the capital calculation and the proposed tenant and letting arrangement. A smaller flat clears only a search filter.

Once those documents exist, compare the project's supported rent with its full cost and the scheme's restrictions. Our [rental-yield calculator](/en/financial-tools/investors/yield) helps budget a specific property; a market gross-yield percentage cannot certify the legal capital test. The broader [Booster guide](/en/insights/booster-fir-de-wunnengsbau-luxembourg-2026-measures) explains the package, while this audit identifies the price-basis check needed before using a listing in that calculation.

## A sound investment need not depend on the new rate

A landlord may find a suitable small flat at a fully documented investor price under the rules that apply to that purchase. Such a deal does not need the announced scheme to be attractive. That is the strongest counterargument to waiting for every new policy detail: assess an available investment on its actual terms.

Our conclusion would change for a particular flat when a valid investor quote, the operative legal benchmark and the other eligibility evidence are available. Until then, treat the table as a guide to further investigation. Would you accept the scheme's letting conditions for the confirmed price advantage, or prefer an investment that works without that advantage?

## Methodology

Calculated on 19 October 2026 from a fixed projection of the first 12,000 active buy records ordered by Firestore document ID, captured at 11:33 UTC. The read limit was reached: this is an audited subset, not a random sample or national census. Keep only catalog-visible, available individual apartment/house records, excluding explicit foreign/cross-border records, places not exactly matched to registry commune names or slugs and the Steinsel location-quality hold. Country absent defaults to the platform's Luxembourg classification; it is not fresh address certification. Retained residential sample n=7365. Types use the platform apartment/house groups. Primary energy is usable only when the stored A–I primary labels agree; absent, invalid or conflicting labels are unusable. Prices must be positive numeric asking prices and not on request. Small flats use recorded living area from specs.area, then area, from 10 to 120 m², and asking price/m² from €500 to €40,000. Medians give each record equal weight and round to the nearest euro. A nonempty stored VAT source phrase is not proof that its interpretation is correct. The stored 3%-included flag count additionally requires ratePercent=3 and priceIncludesVat=true. Records may duplicate the same home. No eligibility is inferred, no market share estimated and no trend claimed. This dated audit changes only after a new capture and review. See /en/prices/methodology for the wider asking-price distinction.

## Limitations

These are listing records in a bounded, non-random subset, not unique homes, completed transactions or the whole live inventory. Property mix, agency coverage, missing fields and possible duplicates limit comparisons. An energy label, asking price or advertised VAT basis cannot certify tax eligibility. No original completion-value records, qualifying renovation expenditure, grant awards or applicable social-VAT median-cap table were joined. Proposed rules are described as proposals as of 19 October 2026.

## Frequently asked questions

### Are these medians the official 8% VAT price caps?

No. They are medians of asking prices in our audited listing subset. The announcement refers to an Observatoire median by region and dwelling size; we have not established an operative cap table for that test.

### Did the 8% VAT scheme start with the October affordable-housing reform?

The October release does not establish that. The July VAT announcement says entry into force of the relevant law, without retroactivity. Verify the applicable commencement text before relying on the measure.
